Terms and Conditions

These terms and conditions govern the sale of products to you by us Home Textiles Warehouse Ltd on hometextilewarehouse.com. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

1. Limited Rights to Use Content 

All material including any intellectual property in it displayed on the Site (“Content”) belongs to Home Textile Ware house or its suppliers. Home Textile Warehouse gives you the right, for your own personal or non-commercial purposes only to (1) retrieve and display the Content on your PC screen; (2) print individual pages on paper; (3) store individual pages in electronic form on CD/disk. You may not store any Content on any server or other storage device connected to an external network, or make any other use of the Content.

Most of the Content is owned by Home Textile Warehouse but certain Content is used with the permission of third parties (“Third Party Content”) and may be subject to additional restrictions.

2. Pricing and Availability 

All products are subject to availability. An In Stock status is an indication only and we will contact you if we are experiencing problems obtaining your product.

Products and prices are subject to change. We will try to ensure prices on this website are accurate; however, we sometimes might get it wrong. If this happens we will contact you immediately with the correct price. All prices are inclusive of any applicable taxes including VAT but do not include a delivery charge

3. Delivery 

The time, if any, specified for the commencement and completion of the supply and delivery of the goods shall be deemed to be variable if delays are occasioned by force majeurs, strikes, lock-out, accidents or any reason whatsoever, and such times, if specified, are approximate only and not of contractual effect. Time of delivery is not of the essence of the contract nor shall the Company be under any liability in respect of any delay in delivery. Goods are delivered to an address designated by the customer.

4. Ordering
All orders are subject to approval. 

The placing of an order and the entering into of an agreement by the customer is conditional on the customer being over 18 years of age. Quotations by the company shall not constitute offers by the company to supply goods or carry out the work referred to therein. Orders placed will not be binding until accepted and confirmed by the Company by electronic mail and only when a charge has been made against the customers card. All such acceptances by the Company are subject to availability of the necessary materials and to the Company being able to obtain any necessary authorisation and/or licenses and to the same remaining valid.

The Company subject to prior sale accepts all Orders and prices of the goods shall be those ruling at the date of delivery. Any Value Added Tax payable in respect of the goods supplied under these conditions will be borne by the customer. If the Company suffers any increased costs by virtue of a variation in the rates of exchange the Company and the Customer hereunder shall renegotiate the contract price of the undelivered goods.

The company reserves the right to decline any order.

5. Payment 

 We accept most major Credit and Debit Cards to make payment. The customer will be asked to submit your card number and expiry date. Once your card is approved the company will send the customer an order confirmation e-mail. The customer’s credit card is charged on the day of dispatch.

The entry of credit card details is conducted on the web site through a Secure Socket Layer.

6. Liability 

Goods invoiced or supplied are not tested or sold as fit for any particular purpose and any term, warranty or condition express or implied or statutory to the contrary is excluded. In no circumstances what so ever shall the Company’s liability (in contract tort or otherwise) to the Customer arising under, out of or in connection with this contract of the goods supplied hereunder exceed the invoice price of the particular goods or section of goods concerned.

All terms (express or implied) relating to the quality of goods are warranties only the breach of which gives no right to reject the goods or repudiate the contract in any circumstances whatsoever.

Notice of any claim arising out or in connection with this contract must be given in writing to the Company within seven days from the date when the goods are delivered failing which all claims shall be deemed to be waived and absolutely barred. In any event, the Company shall be under no liability for shortage or damage unless within three days of delivery the Customer gives written notice of claim to the carrier (otherwise than upon consignment note or delivery document) and the Company shall be under no liability whatsoever unless the Customer can prove to the Company’s satisfaction the identity of the goods complained of.

 7. Force Majeurs

Should the Company be delayed in or prevented from carrying out its obligations under the Contract by Act of God or riot, strike, lock outs, trade disputes or any other labour disturbances, fire, flood, difficulty in obtaining workmen, materials or transport or the consequences of hostilities of any government interference or other circumstances whatsoever outside the Company’s control and the Company shall not be liable to the buyer for any loss or damage whether direct or indirect which contract may thereby be suffered by the

Customer and furthermore the Company shall be at liberty to determine or suspend the contract without incurring liability for any loss or damage resulting to the Customer.

8. Returns

We hope you are happy with your order. However, if for any reason, you are not satisfied with your order please return the goods to us within 7 days of receipt letting us know your name and order id for a refund. Goods must be in their original packaging, unopened, and in an unused condition together with a valid receipt or other proof of purchase. We are unable to refund postage charges.  For incorrectly delivered or damaged goods please see below #9

Items should be returned in an unused condition with the original packaging.

These terms do not affect your statutory rights.

The return of goods is at your own cost and we recommend you use a recorded or secure delivery method to return your order to us.

To return a product, email info@hometextilewarehouse@gmail.com. Please provide your order number, the date of purchase, your name and contact details, the product you wish to return and the reason.

9.  Incorrect or Damaged Goods

It is your responsibility to inform us within 3 days of receipt of goods regarding any products that were incorrectly delivered or damaged upon receipt. Contact us at hometextilewarehouse@gmail.com where we will resolve the situation promptly and issue you with a returns number if required. Please have your order id ready when contacting us.

Please do not return any goods that were damaged or incorrectly delivered before contacting us.

This does not affect your statutory rights.

8. General 

We reserve the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.

We reserve the right to amend, remove or vary the Services and/or any page of this Website at any time and without notice.

Irish law will apply to this Agreement. All contracts that result from the use of this website are concluded in English.
